Terms of Service & Freight Policies

Understanding our partnership agreement is key to a successful logistics relationship. These Terms of Service constitute a legally binding agreement between TSM Trucking and Hauling LLC and our clients.
Please read these Terms carefully before using the services operated by TSM Trucking and Hauling LLC. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Definitions
- Carrier: TSM Trucking and Hauling LLC, providing transportation and logistics services.
- Shipper: The entity requesting the transportation of goods and responsible for freight charges.
- Consignee: The party designated to receive the shipment at the specified destination.
- Bill of Lading (BOL): The official shipping document acting as a receipt and contract of carriage.
- Accessorial Charges: Costs incurred for services beyond standard dock-to-dock transportation.
2. Service Agreement & Bill of Lading
These terms, in conjunction with a signed rate confirmation or Bill of Lading (BOL), constitute the entire freight agreement between the parties. No verbal modifications shall be recognized.
The Shipper is solely responsible for providing complete and accurate information on the BOL, including weight, piece count, hazardous material declarations, and special handling instructions. TSM Trucking and Hauling LLC reserves the absolute right to refuse any shipment that poses a safety risk, is improperly packaged, or is outside our operational capacity.
3. Rates, Payment, and Accessorial Charges
TSM Trucking and Hauling LLC operates on a Net 30 Days payment cycle from the date of invoice unless otherwise agreed upon in writing. Late payments are subject to a 1.5% monthly finance charge.

Fuel Surcharges: Surcharges are adjusted weekly based on the EIA National Average for Diesel Fuel Prices. All quotes provided are subject to the fuel surcharge active at the time of pickup.
4. Liability and Claims
Liability is governed by the Carmack Amendment. TSM Cargo liability is limited to $100,000 per shipment for standard freight and $0.50 per pound for used machinery or equipment, unless additional value is declared and confirmed in writing prior to pickup.
Temperature-Controlled Freight: Shipper must specify the required temperature on the BOL. TSM is not liable for cargo damage resulting from improper pre-cooling by the shipper or latent defects in the product.
Filing a Claim
All claims for loss or damage must be filed within nine (9) months of the delivery date. Claims must include the signed BOL with damage notation, proof of delivery, and invoice showing the value of the goods.
Concealed Damage
Damage discovered after delivery must be reported within 48 hours. Inspection by TSM or an independent adjuster may be required before claim processing.
